Wine Specific Conditions

Legal Requirements/Compliance with Law

You represent and warrant that you are at least twenty-one (21) years of age at the time the order is placed, and, that when delivery of the wine is made either to you or another member of your family who is at least twenty-one (21) years of age shall furnish his or her driver’s or commercial driver’s license or identification card issued under Sections 4507.50 to 4507.52 of the Ohio Revised Code to verify the person accepting delivery is at least twenty-one (21) years of age. Further, you shall warrant against any person at the location of delivery furnishing any false information as to the name, age, or other identification of any person under twenty-one (21) years of age for the purpose of obtaining or with the intent to obtain, wine for a person under twenty-one (21) years of age. You further warrant that wine shall not be furnished or consumed by individuals under the age of twenty-one (21) unless specifically authorized by Ohio law.

You represent and warrant to Buehler’s Wine Club that you are lawfully purchasing the wine from Buehler’s Wine Club, and you shall do nothing to violate directly or indirectly, by act or omission, state and federal liquor laws. You warrant that you are not the holder of any liquor permit issued in the State of Ohio under Ohio law.

Type of Sale

You represent and warrant that you are purchasing wine from Buehler’s Wine Club at retail in original containers not for consumption on the premises where sold (i.e., carry-out or “to-go,”), that Buehler’s Wine Club location at 3540 Burbank Road Wooster, Ohio shall be deemed the location from which the sale of wine was made to you, and that a sale takes place by you placing an order with Buehler’s Wine Club.

Use of Product

You represent and warrant that you intend to use the wine purchased for personal consumption only and not for resale or other commercial purposes. You and Buehler’s Wine Club agree that Buehler’s Wine Club shall bear no responsibility or liability whatsoever in relation to loss, injury, damage, or harm that occurs as a result of, or arising out of, the consumption of the wine by you or any other person, and you hereby release Buehler’s Wine Club from the same on your own behalf and on behalf of your heirs, assigns, and agents.

Indemnification

You shall defend and hold harmless Buehler’s Wine Club in the event of your violation of any sections of these terms and conditions of use, including but not limited to the sections titled “Legal Requirements/Compliance with Law,” “Type of Sale,” and “Use of Product,” which results in a claim made against Buehler’s Wine Club (or any other loss).

Government Warning

(1) ACCORDING TO THE SURGEON GENERAL, WOMEN SHOULD NOT DRINK ALCOHOLIC BEVERAGES DURING PREGNANCY BECAUSE OF THE RISK OF BIRTH DEFECTS.

(2) CONSUMPTION OF ALCOHOLIC BEVERAGES IMPAIRS YOUR ABILITY TO DRIVE A CAR OR OPERATE MACHINERY, AND MAY CAUSE HEALTH PROBLEMS.

Wine Shipping Restrictions

Currently, we are limiting the shipment of wine to the State of Ohio only. The laws regarding the direct shipment of wine are constantly changing. We may expand our service area at a later date as laws permit. For more information on your state’s wine shipping restrictions, please click here.

Credit Card Charges

Orders are by credit card only. We accept Visa, MasterCard, Discover, and American Express.

Minimum Purchase

No minimum purchase is required.

Wine is a Perishable Commodity

Extremes of temperature–cold, heat, or humidity–may adversely affect the condition of your wine during shipment or home storage. The Buehler’s Wine Club is not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment or after delivery to you. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.

Shipping Policy

Standard deliveries in Ohio are shipped via Ground Service. When filling out Shipping Information, please provide a physical address as shipments of alcohol may not be delivered to P.O. Boxes, Military APOs/FPOs/DPOs/MPOs or International Addresses. Standard delivery time is 7 to 10 business days from payment confirmation.

It is the recipient’s or gift giver’s responsibility to provide a current, shippable, physical delivery address. We cannot ship to P.O. Boxes, military APOs/FPOs/DPOs/MPOs or international addresses.

Three delivery attempts will be made before the package is returned to us. Once returned, we must charge a $10 rerouting fee on all packages reshipped. To avoid this inconvenience, we recommend delivery to a commercially zoned business address.

Cancellation Policy

We make every effort to ensure your satisfaction with our offerings; it’s a priority for us. If for any reason you are not entirely satisfied with our service, you may cancel the subscription at any time. Cancellation can be made through the Buehler’s Wine Club website by logging into your account (My Account), select the “Subscriptions” option in the left-side menu, choose “View” for the proper order, then click the “Cancel” option. Cancellation must be made prior to the next term’s payment date to prevent charges for that term. The next payment date is published on the same pages as above.

Returns & Exchanges

Returns and Exchanges are available, but limited to product deliveries where shipping damage has occurred or for products with obvious quality control issues. If you are dissatisfied with the product received, please contact the Buehler’s Wine Club customer service via email (club@buehlers.com) or phone (1-888-BUEHLER) as soon as possible. Explain your dissatisfaction with the product. Due to State and Federal laws all contents (unless broken bottle) must be returned in full to Buehler’s Wooster Milltown Store. Do not discard contents of the bottle. If it is a quality control issue, please re-cork the unused portion for lab analysis purposes and seal the item(s) securely. Packages must be returned prepaid; we cannot accept COD deliveries. We will refund shipping charges only if we have sent the wrong item or the item is defective. If replaced, we will also pay shipping costs for items sent in exchange. Once we receive your returned item(s), we will either credit your original payment for the purchase price or a replacement will be shipped. If we need to replace a wine due to damage in transit, please allow 1-2 weeks following receipt of your service request for replacement to arrive. Please help us deliver your order by verifying the shipping address carefully. Errors or changes in delivery instructions that incur additional charges will be passed on to you.

If you are receiving a credit, the credit card used for the original purchase will be credited. Please allow 1-2 billing cycles for the credit to appear on your statement.

Recalls

In the event of a health or welfare recall of the wine that has been purchased by you, you and Buehler’s Wine Club acknowledge and agree that notice is properly given when Buehler’s Wine Club provides such notice via U.S. Mail to the same address you designated for delivery of the wine. We will also attempt to contact you at the phone number or email provided during checkout.

Tax Policy

Tax charges are based on state and local tax laws and tax rates for the delivery address of your order. Where required, tax will also be applied to the shipping and handling charges. If you return an item for a refund, you will also receive a refund for the taxes you paid for that item. You will not receive a refund for the taxes you paid on the shipping and handling of that item, as the shipping and handling charges are nonrefundable once an item has been shipped.

Please note that on-screen order totals reflect estimated tax. The actual charge to your credit card will reflect all applicable taxes calculated at the time your order is shipped. If you have questions about the taxes on your invoice.
